These Terms and Conditions (the "Terms") apply to your purchase and use of products and services sold through this website (the "Site"). By purchasing or using any Product or Service, you agree to these Terms.

2. Products and services covered by these Terms

2.1 One-time digital product (the "Guide")

The Guide is a digital educational guide delivered electronically (typically by email or through a link provided after purchase).

2.2 Subscription services (the "Protection Plan")

The Protection Plan is a subscription-based service that may include:

  • access to the Guide
  • breach monitoring and alerts
  • monthly security status emails
  • an annual security summary

The exact features included in your plan are described on the checkout page or pricing section at the time of purchase.

3. Data source for breach checks and monitoring

3.1 Third-party source

Breach data and breach lookup results are provided using the Have I Been Pwned® API ("HIBP").

3.2 No affiliation

ProtectGuide is not affiliated with, endorsed by, or sponsored by Have I Been Pwned. Have I Been Pwned is a registered trademark of Troy Hunt.

3.3 Scope and availability of results

Results depend on the HIBP dataset and the availability of the HIBP service. Not every incident on the internet is included in any single dataset, and results may change over time.

4. Educational and informational purpose

The Guide and the Protection Plan provide educational and informational content and monitoring signals. They do not constitute legal, financial, medical, or professional advice. You are responsible for decisions you make based on the information provided.

5. Eligibility

You must be able to form a legally binding contract in your jurisdiction to purchase or use the Products and Services.

6. Pricing, payments, and taxes

6.1 Payments

Payments are processed by Stripe or another payment processor. Your bank statement may show the charge descriptor as "PROTECTGUIDE".

6.2 Taxes

Taxes may apply depending on your location and applicable tax obligations. Any applicable taxes will be shown at checkout.

7. Delivery and access

7.1 Guide delivery

After successful payment, the Guide is delivered to the email address you provide at checkout or made available via a download/access link. Delivery is typically fast but may take up to 2 hours in some cases.

7.2 Subscription access

If your plan includes Guide access, that access is provided while your subscription is active, subject to these Terms.

7.3 Your responsibilities

You are responsible for providing a correct email address and checking inbox, spam, and promotions folders. If you do not receive an email within a reasonable time, contact support and include:

  • the email used at checkout
  • your name (if available)
  • approximate purchase date/time
  • a short description of the issue

8. Subscriptions, renewal, and cancellation

8.1 Auto-renewal

Subscription plans renew automatically at the end of each billing period unless you cancel before renewal.

8.2 Billing periods

Billing periods may be monthly, annual, or multi-year depending on the plan you choose at checkout.

8.3 Cancellation

You can cancel at any time. Cancellation stops future renewals. Unless stated otherwise at checkout, you will keep access until the end of your current paid billing period.

8.4 Price changes

We may change subscription pricing for future periods. If pricing changes, the updated price will apply only to a renewal after we provide notice where required by law.

9. Monitoring inputs and communications

9.1 What we monitor

For the Protection Plan, you provide one or more email addresses for monitoring (as applicable to your plan). We use those inputs to query the HIBP API and to send alerts and summaries.

9.2 Email alerts and deliverability

Alerts and summaries are delivered by email. Email delivery can be affected by spam filters, your provider, or your mailbox settings. We are not responsible for delays caused by third-party email systems, but we will help troubleshoot when possible.

10. Personal-use license and restrictions

10.1 License

When you purchase the Guide, you receive a personal, non-exclusive, non-transferable license to use it for your own personal use.

10.2 You may

  • use the Guide on your own devices
  • print a reasonable number of copies for personal use

10.3 You may not

  • share, resell, distribute, repost, upload, or provide the Guide (or any portion of it) to others
  • claim the Guide as your own
  • use the Guide for commercial purposes (including training, resale, or client work) without written permission

11. Intellectual property

The Products, Services, and all related content are owned by the Seller and protected by applicable intellectual property laws. All rights not expressly granted are reserved.

12. Refunds

12.1 One-time Guide

Because the Guide is a digital product delivered electronically, all sales are generally final once delivered.

12.2 Subscription plans

Subscription fees are generally non-refundable once a billing period begins. You can cancel to prevent future renewals.

12.3 Exceptions

If you were charged more than once, charged in error, or can show verified non-delivery or access failure after contacting support, you may request help by emailing us within 14 days of the charge. We may, at our discretion, provide a fix, resend access, or issue a refund in cases such as duplicate charges or verified non-delivery. Nothing in these Terms limits any refund rights required by applicable law.

13. Acceptable use and service integrity

You agree not to misuse the Site, the Products, or the Protection Plan, including attempting to scrape, overload, or reverse engineer systems, or using the service in a way that violates applicable law. We may suspend access if we reasonably believe there is abuse, fraud, or a security risk.

14. Disclaimers

The Products and Services are provided "as is" and "as available." We do not guarantee any specific outcome, and we do not guarantee that every breach or incident will be detected. We aim to provide helpful information, monitoring signals, and clear action guidance, but results can vary depending on individual circumstances and third-party systems.

15. Limitation of liability

To the fullest extent permitted by law:

  • the Seller will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill related to your purchase or use
  • the Seller's total liability for any claim related to the Products or Services will not exceed the amount you paid for the relevant Product or the most recent subscription charge giving rise to the claim

16. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of your purchase applies to that purchase. For subscription services, updated Terms may apply to future use of the service after the effective date.

17. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and applicable federal laws of Canada. Any disputes will be handled in the courts located in Toronto, Ontario, unless applicable law requires otherwise.
